Plane crash puts Russia's airline industry in spotlight - again

A Russian plane carrying only crew slid off the runway and crashed yesterday, the latest in a steady stream of such incidents that has given Russia one of the world's worst air traffic safety records.

The crash during peak holiday travel ahead of Russia's?New Year's vacation, which runs from Sunday through Jan. 9, cast a spotlight on the country's poor air safety record despite President?Vladimir Putin's calls to improve controls.

Television footage showed the?Tupolev Tu-204?jet with smoke billowing from the tail end and the cockpit broken clean off the front.

Some witnesses told state channel Rossiya-24 they saw a man thrown from the plane as it rammed into the barrier of the highway outside?Vnukovo airport, just southwest of the capital, and another described pulling other people from the wreckage.

"The plane split into three pieces,"?Yelena Krylova, chief spokeswoman for the airport, said in televised comments.

Police spokesman?Gennady Bogachyov?said: "The plane went off the runway, broke through the barrier, and caught fire."

The pilot, co-pilot, flight engineer, and a flight attendant were killed and the other four crew members aboard ? all flight attendants ? were in a serious condition in the hospital with head injuries, the?Emergency Situations Ministry?said.

Officials said earlier that there were 12 crew on board.

The mid-range?Tu-204?was operated by Russian airline Red Wings and was traveling from the?Czech Republic, Krylova said.

In parts of Israel, it's hard to find a single Hebrew sign in a sea of Cyrillic. Shopkeepers address customers in Russian, and groceries are amply stocked with non-kosher pork, red caviar and rows of vodka. Russian pop beats thump at bars, and in some homes, people will as likely be hunched over a chessboard as a computer keyboard.

The Soviet Union crumbled 20 years ago, and in the aftermath, more than 1 million of its citizens took advantage of Jewish roots to flee that vast territory for the sliver of land along the Mediterranean that is the Jewish state. By virtue of their sheer numbers in a country of 8 million people and their tenacity in clinging to elements of their old way of life, these immigrants have transformed Israel.

Israel has the world's third-largest Russian-speaking community outside the former Soviet Union, after the U.S. and Germany. Russian-speaking emigres may not conjure up the same recognition as the country's black-hatted Orthodox Jews or gun-toting soldiers, but they are just as ubiquitous ? maintaining habits more suited to the "old country" than their adopted Mideast homeland, like wild mushroom foraging or winter dips in the Mediterranean, the closest substitute to frigid Siberian waters.

Today, Russian-speaking emigres and their children occupy virtually every corner of Israeli society, from academia and technology to the military and politics. A political party formed by Israel's recently resigned foreign minister to cater to Russian-speaking immigrants like him has grown from a marginal force in politics to one of its major powers.

The Russian-speaking community also wields an outsized influence in other aspects of Israeli life. Every fourth employee in Israel's flourishing high-tech industry is a Russian-speaking immigrant, as is every other engineer. The world's second-ranked chess master, Belarus-born Boris Gelfand, lives in Israel, and about a quarter of Israel's Olympic coaches grew up in the former Soviet Union.

Not all newcomers found work in their professions. Many artists became janitors or teachers. One Moldovan trapeze artist now operates a crane.

"I love the circus very, very much, but my work is like the circus," said Irena Zagoruyko, speaking by cellphone atop a 56-meter (185-foot) crane.

While the wave of immigration from the former Soviet Union is widely regarded as successful, there were also frictions.

Religion is a sensitive subject. Many immigrants have tenuous Jewish lineage or none at all.

There is also a certain disdain on both sides, with some immigrants saying they brought talent to a cultural backwater, and some Israelis saying the Russian-speaking immigrants brought prostitution, corruption and crime.

To some degree, many Russian speakers have insulated themselves from the broader Israeli society with Russian bookshops, Russian restaurants, Russian television and Russian newspapers.

And they never forget the beloved Chekhov and Dostoyevsky of their motherland.

"That's why Soviet immigrants never connected to Israeli society all the way," says Roman Bronfman, a former Israeli lawmaker born in today's Ukraine. "They felt they were connected to one of the most glorious cultures in the world."

NOAA lists ringed and bearded ice seal populations under the Endangered Species Act

Dec. 30, 2012 ? NOAA Fisheries announced on December 21, in compliance with a court ordered deadline, its final listing decision for four subspecies of ringed seals and two distinct population segments (DPSs) of bearded seals under the Endangered Species Act. Specifically, in line with the proposal, NOAA will list as threatened the Beringia and Okhotsk DPSs of bearded seals and the Arctic, Okhotsk, and Baltic subspecies of ringed seals. The Ladoga subspecies of ringed seals will be listed as endangered. The species that exist in U.S. waters (Arctic ringed seals and the Beringia DPS of bearded seals) are already protected under the Marine Mammal Protection Act.

This science-based listing decision will not result in any immediate restrictions on human activities; however, Federal agencies that permit or fund projects that may affect a listed species must consult with NOAA Fisheries to ensure the existence of the species is not jeopardized. In addition, this listing will have no impact on the subsistence harvest of ice seals by Alaska Natives, a practice that is central to the traditional culture and nutrition in many Alaskan Native coastal communities.

"Our scientists undertook an extensive review of the best scientific and commercial data. They concluded that a significant decrease in sea ice is probable later this century and that these changes will likely cause these seal populations to decline," said Jon Kurland, protected resources director for NOAA Fisheries' Alaska region. "We look forward to working with the State of Alaska, our Alaska Native co-management partners, and the public as we work toward designating critical habitat for these seals."

NOAA will work with local, state and Native partners, as well as the public to help determine whether to propose critical habitat designations for Arctic ringed seals and the Beringia DPS of bearded seals. This decision will happen at a later date, after compiling significant additional scientific and economic data and public input. Earlier this year, the President directed that any future designations of critical habitat carefully consider all public comments on relevant science and economic impact, including those that suggest methods for minimizing regulatory burdens. Any potential future critical habitat designation will include a full analysis of economic impact, including impact on jobs, and will strive, to the extent permitted by law, to avoid unnecessary burdens and costs on states, tribes, localities, and the private sector.

Ringed and bearded seals depend on sea ice and snow to survive. After a comprehensive review of the best available science including climate models developed by the Intergovernmental Panel on Climate Change, NOAA has concluded that sea ice and snow cover are likely to further decrease in the foreseeable future resulting in population declines that threaten the survival of these seals.

Ringed seals nurse and protect their pups in snow caves, which are threatened by late ice formation in the fall, rain-on-snow events in the late winter, earlier break-up of spring ice, as well as decreasing snow depths, which are projected to be too shallow for snow cave formation by the end of the century. Both ringed seals and bearded seals rely on sea ice for extended periods during molting, and bearded seals live on sea ice during critical months for breeding, whelping, and nursing. Sea ice is projected to shrink both in extent and duration, with bearded seals finding inadequate ice even if they move north.

NOAA Fisheries proposed the listings in December 2010 and provided opportunities for public input through public comment periods and during public hearings held in Anchorage, Barrow, and Nome. In accordance with NOAA's Policy for Peer Review in ESA Activities, the agency also solicited comments from peer reviewers on each of the proposed rules. In December 2011, NOAA administratively extended the deadline for final listing determinations six months to June 2012 to allow for additional consideration of relevant science and information. In November 2012, the Alaska district court ordered NOAA to respond to a complaint about further delay by December 21, 2012.

The Endangered Species Act defines an endangered species as "any species which is in danger of extinction throughout all or a significant portion of its range." A threatened species is "any species which is likely to become an endangered species within the foreseeable future throughout all or a significant portion of its range."

The Endangered Species Act requires species listed as endangered to receive the full protection under the Act to prevent extinction, including a prohibition against "take," which includes harassing, harming, pursuing, wounding, killing, trapping, capturing, or collecting. These protections may also be established for threatened species to prevent them from becoming endangered, but NOAA does not propose pursuing such a rule at this time.

Couples wed as gay marriage comes to Maine

PORTLAND, Maine - Gay and lesbian couples exchanged their vows early Saturday as Maine's new same-sex marriage law took effect a minute after midnight.

Among them were Steven Bridges and Michael Snell, who held a commitment ceremony six years ago but wanted to make their marriage official under state law.

"It's historic. We've waited our entire lives for this," said Bridges, a retail manager, who's been in a relationship with the Snell, a massage therapist, for nine years. Bridges, 42, and Snell, 53, wore lavender and purple carnations on black T-shirts with the words "Love is love."

With Snell's two adult daughters looking on, they exchanged their vows in the city clerk's office after getting the first marriage license issued to a same-sex couple in Portland. They said they'll hold another ceremony with friends this summer, after the weather warms up.

Voters approved gay marriage in November, making Maine and two other states the first to do so by popular vote. A law is already in effect in Washington state; Maryland's takes effect Tuesday.?

Nine of the 50 U.S. states plus the District of Columbia, have now legalized gay marriage. Another 31 states have passed constitutional amendments banning it.

In Portland, a half dozen couples huddled with friends and family in freezing temperatures outside the building before the doors to the city clerk's office were opened at 10 p.m. local time.


"We've been together for 30 years, and never thought that this country would allow marriages between gay couples," said Roberta Batt, 71, an antiques dealer and retired physician with silver hair and round eyeglasses. She planned to marry her longtime partner, Mary, who stood nearby.

"We're just very thankful to the people of Maine, and I hope the rest of the country goes the way this state has," she added.

Suzanne Blackburn and Joanie Kunian, of Portland, were among those in line to get their license at midnight, but they didn't plan to wed immediately. One of their grandchildren wanted them to get married on Valentine's Day.

"I don't think that we dared to dream too big until we had the governor's signature," Blackburn said. "That's why it's so important, because it feels real."

In Bangor, the city clerk's office was planning to be open on Saturday from 6 a.m. to 8 a.m. for residents to obtain marriage licenses. The Brunswick town clerk's office was set to be open from 9 a.m. to noon on Saturday by appointment. As of midday on Friday, five same-sex couples had booked appointments, the office said.

More lavish same-sex weddings are being booked starting in the spring at the On the Marsh Bistro in Kennebunk, said owner Denise Rubin.

"We support it wholeheartedly," she said. "We look forward to being part of a whole new wave of wonderful thinking."

The tide of public opinion has been shifting in favor of allowing same-sex marriage. In May, President Barack Obama became the first U.S. president to say he believed same-sex couples should be allowed to get married.

A Pew Research Center survey from October found 49 percent of Americans favored allowing gay marriage, with 40 percent opposed. The U.S. Supreme Court has agreed to review two challenges to federal and state laws that define marriage as a union between a man and a woman.

Just a day after Washington became the latest state to allow gay couples to marry, the U.S. Supreme Court will take a serious look at same-sex marriage for the first time ever. NBC's Pete Williams reports.

The nation's highest court said this month it will review a case against a federal law that denies married same-sex couples the federal benefits that heterosexual couples receive. It also will look at a challenge to California's ban on gay marriage, known as Proposition 8, which voters narrowly approved in 2008.

Washington state's law legalizing same-sex unions took effect on Sunday, December 9, and Maryland's law takes effect on January 1, 2013.

Former President Bush moved out of intensive care

HOUSTON (AP) ? Former President George H.W. Bush's condition continued to improve Saturday, prompting doctors to move him out of intensive care, a spokesman said.

"President Bush's condition has improved, so he has been moved today from the intensive care unit to a regular patient room at The Methodist Hospital to continue his recovery," family spokesman Jim McGrath said Saturday. "The Bushes thank everyone for their prayers and good wishes."

Bush was hospitalized Nov. 23 for treatment of a bronchitis-related cough. He was moved to intensive care at the Houston hospital on Dec. 23 after he developed a fever.

On Friday, McGrath said Bush had improved since arriving in the ICU. He said he was alert and in good spirits and was even doing some singing.

McGrath said Saturday morning that future updates on Bush's condition would be made as warranted.

Bush, the 41st president, is the country's oldest living former president by a few months.

Since I was in the wheelchair and not on my crutches, I rolled around looking for these aforementioned items, I got trapped in the narrow isles because I could not turn around, people in front of in back of me a rolling ladder in front of me. I tried to navigate around a corner, a cardboard box in the middle of the isle, some moron starts walking towards me in the only space the wheel chair could go. I had to back up because this butt didn't even flinch as if he would have stopped. I had to roll back into the isle I was just in. Few minutes later I was up by geek squad info arealwent down one isle people walked in and starting to look at something. After a few seconds I backed up out of the isle, I couldn't turn around and when I did, I found the isle I need to get to my wife blocked by a roof support pole and people looking at something. Behind me was the lines of the registers and geek squad consulting areas. UNABLE TO GO ANYWHERE I SAT THERE WAITING FOR OVER 5 MINUTES.

I am only only a temporary wheelchair user. I feel sorry for any disabled person who needs a to use a wheel chair on a daily basis that uses this store.

Black Monday: NFL Coaches That Could Be Fired After Week 17

As many as 13 teams could both fire their current head coach and begin to scour the NFL assistant and college ranks for their next leader. Some general managers could also be on the the move.

Below breaks out each possible firing, and a reason for why.

Philadelphia Eagles- Andy Reid

It?s been predicted for more than a month, and is the most likely to happen. The Eagles knew their season was going nowhere, but had more respect for Reid than letting him him go in the middle of the year. During his tenure Reid has a 130-92 record, with seven division titles and one trip to the Super Bowl.

Many of the below teams could offer him a job for next season, assuming Reid wants to immediately return to coaching.

Cleveland Browns- Pat Shurmur

The Browns are under new ownership who may want to start fresh. Still, Shurmur rallied his team midway through the season after an 0-5 start, and Cleveland had big wins over division rivals Cincinnati and Pittsburgh.

Dallas Cowboys- Jason Garrett

If New Orleans hadn?t come to terms with Sean Payton, would Garrett be safe now?

It?s important to consider, because if the Cowboys don?t beat Washington, they?ll miss the playoffs for the third straight year. Dallas has come on towards the end of the season, and reportedly Garrett will have one more go round even if the Cowboys miss the postseason.

Buffalo Bills- Chan Gailey

According to reports, Gailey is out. The Bills could also fire their general manager Buddy Nix. Buffalo gave Gailey three years to turn around a club that hasn?t made the playoffs in 13 years, and invested heavily this offseason to improve its defense, only for the Bills to rank dead last against the rush.

Carolina Panthers- Ron Rivera

Rivera?s second season with Carolina has played much the same way as his first. The Panthers started out of the gate 2-8, and have now won four of their last five games.?

Carolina is still looking for a full-time general manager, who could make the final call on bringing Rivera back for one more year.

Arizona Cardinals- Ken Whisenhunt

The Cardinals and Whisenhunt had the worst trouble with quarterbacks this season. Arizona could not find the right man to put under center, and they fielded the worst scoring offense in the league as a result.

A strong 4-0 start, followed by nine consecutive losses, will probably clinch Whisenhunt?s exit.?

Jacksonville Jaguars- Mike Mularkey

The Jaguars are also expected to clean house with a new coach and GM. Mularkey had just one year, but couldn?t seem to get his offense or second-year quarterback Blaine Gabbert going.

Reports have pegged Reid, and even Alabama?s Nick Saban as possible targets for new owner Shad Khan.

Kansas City Chiefs- Romeo Crennel

Put Crennel and GM Scott Pioli alongside tandems that will be shown the door after Week 17. Like Arizona, the Chiefs don?t have a proper quarterback to help out running back Jamaal Charles.

Kansas City was also tied to rumors of another TV analyst, NBC?s Tony Dungy. But the former Super Bowl winning coach has denied the rumors and said he will not return to the sidelines.

New York Jets- Rex Ryan

Ryan has battled media leaks all season regarding his quarterbacks, and said Friday he wants to stay with New York for 15 years.

For now his job may be safe, and so is GM Mike Tannebaum?s. Both will need to figure out how to solve the Jets woeful offense if they are to survive next season.

Tennessee Titans- Mike Munchak

Texas rallies for 31-27 Alamo Bowl win over Oregon State

SAN ANTONIO -- David Ash threw two fourth-quarter touchdown passes, the last a 36-yard strike to Marquise Goodwin with 2:24 left, to give Texas a 31-27 comeback victory over No. 15 Oregon State in the Alamo Bowl on Saturday night. ?

The Longhorns (9-4) never led before Goodwin scored his second touchdown on a deep post pattern, just a down after Texas converted a fourth-and-1 play to keep its chances alive. ?

Storm Woods ran for 118 yards and scored two touchdowns for Oregon State (9-4). The Beavers left stunned after looking as though they would wrap up their first 10-win season since 2006. ?

Down 20-10 at halftime, Texas coach Mack Brown said he told his players they would win. ?

"I told them this it wasn't going to be easy, but I told them this game was ours and we would win it," Brown said. "This one is really special." ?

The victory was a dose of much-needed good news for Texas after coming into the game under a cloud of questions following the suspensions of backup quarterback Chase McCoy and injured linebacker Jordan Hicks. ?

Ash, whose been pulled at times for McCoy this season, was 21 of 33 for 241 yards. Ash sputtered until the fourth quarter, when he went 9 for 11 for 146 yards. Texas had no choice but to stick with the only backups two redshirt freshmen who haven't taken a snap all season.? ?

Brown announced the suspensions Friday but wouldn't reveal which players were sent home. A person with knowledge of the suspensions told The Associated Press the players were McCoy and Hicks, speaking on condition of anonymity because Texas wasn't releasing the names. ?

Brown addressed the suspensions during a previously schedule news conference and referred to a local TV report that police were investigating two unidentified Texas players in an alleged sexual assault at a San Antonio hotel. Police released a heavily redacted incident report that only identifies the suspects as two students, one 20 and the other 21. ?

Authorities are still investigating and no charges have been filed. ?

Brown said he would not address the suspensions further. ?

Oregon State quarterback Cody Vaz was 15 of 28 for 194 yards. The Beavers had negative 4 yards in the fourth quarter as they were muffled by the Longhorns defense that was led by Alex Okafor, who finished with 4 1/2 sacks. The Longhorns had 10 sacks in the game.

Although Goodwin's touchdown catch might have won the game, two spectacular Texas plays in an earlier 83-yard scoring drive handed the Longhorns momentum -- and a chance. ?

First was wide receiver Jaxon Shipley rescuing a pass sailing behind him with a dazzling one-handed grab at midfield. Ash made up for that off-target throw six plays later, slithering out of safety Anthony Watkins' near-certain sack and flinging the ball to Jonathan Gray, who then zipped down the sideline for a 15-yard scoring play that got the Longhorns to 30-27. ?

The Longhorns played for a national championship in 2009. What's followed has been the shakiest of Brown's 15 years at Texas: a combined 22-16 record, an overhaul of assistant coaches and stubborn instability at quarterback following seven spoiled years with Heisman Trophy finalists Colt McCoy -- the suspended player's brother -- and Vince Young under center. ?

A surge of four consecutive victories late this season put this nine-win season in reach -- a benchmark that had been the ho-hum standard of the Brown era. It comes following an unexpected twist earlier this month, when school President Bill Powers went to his blog to write that Brown had his "full support" and would remain the head coach. ?

Powers cited an increase an "increase in media speculation" about Brown's future. It was published on his blog the same day Brown would not yet commit to Ash or Case McCoy as his starting quarterback for the Alamo Bowl. ?

Also, this will go a long way in making your follow-up and follow-thru easier. 6. Be a valuable resource to those you meet when moving around the room of an event.? BERLIN (AP) ? The case of an 87-year-old Philadelphia man accused by Germany of serving as an SS guard at Auschwitz has largely centered on whether he was stationed at the part of the death camp used as a killing machine for Jews.

Johann "Hans" Breyer ? while admitting he was an Auschwitz guard ? insists he was never there.

World-War II-era documents obtained by The Associated Press indicate otherwise.

The files provided by the U.S. Department of Justice in response to an AP request are now in the hands of German authorities, and could provide the legal basis for charging him as an accessory to the murder of hundreds of thousands of Jews in the Nazi death camp.

The retired toolmaker told the AP in September, when German authorities confirmed he was under investigation, that he was always at Auschwitz I, a smaller camp used largely for slave labor, and never entered Auschwitz II, also known as Auschwitz-Birkenau, where about 90 percent of the 1.1 to 1.5 million Jews and others killed in the camp were murdered.

The U.S. Justice Department documents tell a different story. One SS administrative document specifically notes that Breyer was an SS guard at Auschwitz II. Another indicates he served with a unit of the SS Totenkopf, or "death's head," that was assigned to guard Birkenau.

Kurt Schrimm, the head of the special German prosecutors' office responsible for investigating Nazi-era crimes, which has recommended charges be brought against Breyer in Germany, would not comment on specific pieces of evidence. But he said his office felt there was a strong enough evidence to prove that Breyer served in Birkenau.

"American authorities have been very cooperative in this case and have turned over a lot of evidence," he said.

Breyer did not respond to requests for comment; his attorney, Dennis Boyle, said that he was aware of the documents but would not comment on their possible significance. "We are continuing our investigation and have no comment at this time," Boyle said.

The U.S. Department of Justice used the documents as part of its unsuccessful decade-long legal efforts to have Breyer stripped of his American citizenship and deported. The U.S. case centered upon issues such as whether Breyer had lied on his immigration papers and whether he had obtained U.S. citizenship through his American-born mother. That legal saga ended in 2003, with a ruling that allowed him to stay in the United States, mainly on the grounds that he had joined the SS as a minor and could therefore not be held legally responsible for participation in it.

The German investigation, by contrast, tries to prove that Breyer was a death camp guard, and the documents are now being used to support that case.

The dossier is now with prosecutors in the town of Weiden, near where Breyer last lived in Germany. The prosecutors are reviewing whether there is enough evidence to charge him with accessory to the murder of least 344,000 Jews as Schrimm's office has recommended, and have him extradited from the U.S.

For decades after the war, German prosecutors were only been able to convict former Nazi guards if they could find evidence of a specific crime. But with the case of former Ohio autoworker John Demjanjuk, the legal thinking changed: Prosecutors were able to successfully argue that evidence of service as a death camp guard alone was enough to convict a suspect of accessory to murder.

Demjanjuk always denied being a guard anywhere. He died in March while appealing his conviction on 28,060 counts of accessory to murder. Breyer, however, acknowledges that he served with SS Totenkopf guard units ? although not the one that served at Birkenau ? and was stationed both at Buchenwald, a concentration camp located in Germany, and Auschwitz.

"I didn't kill anybody, I didn't rape anybody ? and I don't even have a traffic ticket here," he told the AP in an interview at his home in northeastern Philadelphia in September. "I didn't do anything wrong."

He said he was aware of what was going on inside the death camp, but did not witness it himself. "We could only see the outside, the gates," he said. The interview was the only one Breyer has given to the media.

Breyer was born in 1925 in what was then Czechoslovakia to an ethnic German father and an American mother, Katharina, who was born in Philadelphia. Slovakia became a separate state in 1939 under the influence of Nazi Germany. In 1942, the Waffen SS embarked on a drive to recruit ethnic Germans there. Breyer joined at age 17 and was called up in 1943.

In testimony in 2002, he told the U.S. District Court in Pennsylvania that he had been sent to Auschwitz from Buchenwald in May 1944, then was given leave in August and returned home. He testified that he stayed in hiding in and around his home until the Soviet army closed in.

According to Breyer, the town's mayor provided him a letter asking for authorities to excuse his desertion because he had been needed on the family farm. Breyer testified that the letter worked with Nazi authorities, and that he was able to eventually rejoin his unit fighting outside Berlin in the final weeks of the war.

The documents, however, call his testimony into question, suggesting he was at Auschwitz through the rest of 1944 and into 1945, which would have meant he was there during the time some 426,000 Hungarian Jews were deported to Auschwitz, 320,000 of whom went directly into the gas chambers in Auschwitz-Birkenau.

A form from SS administrative authorities, filled out on Jan. 17, 1945 in Pressburg, which today is Bratislava, Slovakia, indicates that the previous day Breyer was there in person and applied for ? and was granted ? financial assistance for his parents' farm while he was away serving in the SS.

And it notes that Breyer at the time of the application was based at "Auschwitz 2."

In a 2002 case in the United States, the judge questioned the trustworthiness of the document ? noting among other things that the birthdates of both of Breyer's parents were wrong, and the size of his family farm was written down as double what it actually was. In his testimony, Breyer suggested the document was "a fraud."

But a court expert testified there was no evidence of a forgery. And U.S. federal prosecutors noted that Breyer's date of birth, date of induction into the SS, profession, parents' names and hometown are all correct. They also cited Breyer's first interrogation in 1991, when he told investigators he had gone home after "they granted me vacation end January '45" ? which fits with the timeline of the document.

In the current German case, Thomas Walther, a former prosecutor in Schrimm's office, said it was also plausible to think that Breyer would have made his parents seem older, and his farm larger, in order to bolster the case for receiving assistance.

If nothing else, he said, the document and other evidence raise enough suspicion for prosecutors to file charges.

"Where this evidence fits has to be decided at trial, regardless of what the U.S. judge said the German court needs to decide," said Walther, who is now in private practice and represents several family members of Jewish victims at Auschwitz who have joined the investigation as co-plaintiffs as allowed under German law.

Weiden prosecutor Gerhard Heindl, who is heading the current investigation, said he could not comment on any evidence.

Another document, an April 26, 1944 letter to the SS administration in Pressburg from the leader of the pro-Nazi Slovakian "Deutsche Partei," makes a case to have Breyer excused from his duties to help on his family's farm, noting that he was assigned at the time to the 8th Company of the SS Totenkopf in Auschwitz.

The 8th Company was stationed at Auschwitz II during the time Breyer is alleged to have been there, according to camp orders cited by Raul Hilberg in his book "The Destruction of the European Jews."

A U.S. Army intelligence file on Breyer, obtained by the AP, from a 1951 immigration background check also lists him as being with the SS Totenkopf in Auschwitz as late as Dec. 29, 1944 ? four months after he said he deserted. The Army Investigative Records Repository file was obtained by the AP from the National Archives through a Freedom of Information Act request.

"Clearly we can't say what the result will be at the end of a long presentation of evidence to a court ? that's not our job," Walther said. "But our contention is with this evidence the state prosecutors must file charges."

Venezuela VP in Cuba to visit ailing Chavez

HAVANA (AP) ? Venezuela's vice president arrived in Havana to visit President Hugo Chavez as he recovers from cancer surgery, Cuban official media said early Saturday.

Communist Party newspaper Granma published online a photo of Vice President Nicolas Maduro being greeted at the airport in the Cuban capital by the island's foreign minister, Bruno Rodriguez.

"From there, (Maduro) went directly to the hospital where President Hugo Chavez Frias is receiving treatment to greet his family members and Venezuelan Science and Technology Minister Jorge Arreaza Monserrat, and to discuss with doctors the adequate moment to visit the President the same day," the paper said.

Granma added that Maduro was accompanied by Venezuelan Attorney General Cilia Flores.

The previous night in Caracas, Venezuela, Maduro did not specify how long he would be away but said Energy Minister Hector Navarro would be in charge of government affairs in the meantime.

Maduro's trip comes amid growing uncertainty about Chavez's health.

The Venezuelan leader has not been seen or heard from since undergoing his fourth cancer-related surgery Dec. 11, and government officials have said he might not return in time for his scheduled Jan. 10 inauguration for a new six-year term. There have been no updates on Chavez's condition since Maduro announced Monday night that he had received a phone call from the president who was up and walking.

Maduro is the highest ranking Venezuelan official to visit Chavez since the surgery. Bolivian President Evo Morales traveled to Cuba last weekend in a quick trip that only added to the uncertainty surrounding Chavez's condition. Morales has not commented publicly on his visit or even confirmed that he saw Chavez while he was there.

Earlier Friday, Maduro read a New Year message from Chavez to Venezuelan troops, though it was unclear when the president composed it.

"I have had to battle again for my health," Chavez said in the message. He expressed "complete faith in the commitment and loyalty that the revolutionary armed forces are showing me in this very complicated and difficult moment."

A group of opposition candidates demanded Friday that Maduro provide an official medical report on Chavez's health. Lawmaker Dinorah Figuera said the country needs "a medical report from those who are responsible for the diagnosis, evaluation and treatment of the president."

"The Venezuelan people deserve official and institutional information," Figuera told Venezuelan media.

Before leaving for Cuba, Chavez acknowledged the precariousness of his situation and designated Maduro as his successor, telling supporters they should vote for the vice president if a new presidential election was necessary.

A legal fight is brewing over what should happen if Chavez, who was re-elected in October, cannot return in time for the inauguration before the National Assembly.

National Assembly Diosdado Cabello insisted Monday that Venezuela's constitution allows the president to take the oath before the Supreme Court at any time if he cannot do it before the legislature on Jan. 10.

Opposition leaders argue the constitution requires that new elections be held within 30 days if Chavez cannot take office Jan. 10. They have criticized the confusion over the inauguration as the latest example of the Chavez government's disdain for democratic rule of law and have demanded clarity on whether the president is fit to govern.

Mothers of Invention singer Ray Collins dies

Ray Collins, the guitarist who helped found the Mothers of Invention with?Frank Zappa, died on Monday after being admitted to the hospital a week earlier for cardiac arrest, the?New York Times?reports. He was in his mid-70s.

While the Mothers of Invention helped pave the way for avant-garde rock, Collins started his music career singing in the R&B cover band the Soul Giants. Collins met Zappa in 1961 after seeing him perform at the Sportsman Tavern in his native Pomona; Zappa later joined the group after Collins fired the guitarist Ray Hunt. How the firing actually went down, though, is the subject of some speculation: Zappa said in one interview that Collins "punched [Hunt's] lights out." Collins, however, recalled it differently, with no punching involved.

The addition of Zappa transformed the group. The guitarist encouraged the group to perform original material (often his own), and soon the Soul Giants changed their name, first to the Mothers and eventually to the Mothers of Invention. Collins sang lead on the Mothers of Invention's first record, "Freak Out!"?(1966), as well as its follow-up "Absolutely Free"?(1967). He quit the band after that album.

In a 2009 interview with?The Inland Valley Daily Bulletin, Collins said he'd grown tired of Zappa's emphasis on satire: "I wanted to make beautiful music. I was raised on Johnny Mathis and Nat King Cole." Still, Collins reunited with his former bandmate several more times, including on the 1968 doo-wop concept album "Cruising with Ruben & the Jets."

In recent years, Mr. Collins was reportedly living out of a van in Claremont, California, where he was frequently seen on sidewalk benches. He'd worked as a taxi driver in Los Angeles and a dishwasher in Hawaii, receiving Social Security checks and some royalties from "Memories of El Monte," a ballad he and Zappa wrote based on the chords to the Penguins' "Earth Angel."

Now that Christmas is over, President Obama and Speaker Boehner will soon resume talks to cut Social Security as part of a deal to avert the fiscal cliff. Here are 10 reasons why the chained CPI -- the Social Security cut they are considering -- is terrible policy.

1. Chained CPI is a significant benefit cut that compounds over time, hitting late old-age beneficiaries and the long-time disabled hardest. For a worker with average earnings retiring at age 65 in 2015, chained CPI would cut benefits $653 a year (3.7 percent) at age 75, $1,139 a year (6.5 percent) at age 85 and $1,611 a year (9.2 percent) at age 95.

2. Chained CPI hits current beneficiaries. Even Paul Ryan tried to hold people ages 55 and older harmless from his plan to privatize Medicare (and Social Security before that). Seriously. Check out page 52 of his 2013 budget, and every speech he ever gave on the topic. The theory is, if you're gonna burn people, give them some time to adopt a Spartan lifestyle for several years so they can make up for the lost pension money in time for retirement.

3. Chained CPI cuts benefits for veterans. At least 771,000 veterans receive both Social Security and VA disability benefits. Under chained CPI, both would be cut. A fully disabled veteran claiming benefits at age 30 in 2012 would see a cut in VA benefits alone of $1,425 a year (4.3 percent) at age 45, $2,341 a year (7 percent) at age 55, and $3,231 a year (9.7 percent) at age 65.

4. Chained CPI cuts benefits for the indigent elderly and disabled on Supplemental Security Income (SSI). Do I need to add detail here? These are the poorest of the poor.

5. Chained CPI is less accurate for seniors and people with disabilities. Chained CPI assumes people can substitute cheaper products as prices go up, but this is not true of seniors and people with disabilities for whom health care makes up a larger share of expenses. In 2009, health care made up 12.9 percent of expenses for people 65 or older, but 5.3 percent of spending for people ages 25-64.

6. A more accurate CPI for Social Security is the CPI-E, not the chained CPI. NYC Subway Slaying: Man Pushed To Death In Front Of 7 Train

NEW YORK ? A mumbling woman pushed a man to his death in front of a subway train on Thursday night, the second time this month someone has been killed in such nightmarish fashion, police said.

The man, who wasn't immediately identified, was standing on the elevated platform of a 7 train in Queens at about 8 p.m. when he was shoved by the woman, who witnesses said had been following him closely and mumbling to herself, New York Police Department chief spokesman Paul Browne said. It didn't appear the man noticed her before he was shoved onto the tracks, police said.

The woman fled, and police were searching for her. She was described as Hispanic, in her 20s, heavyset and about 5-foot-5, wearing a blue, white and gray ski jacket and Nike sneakers with gray on top and red on the bottom.

It was unclear if the man and the woman knew each other or if anyone tried to help the man up before he was struck by the train and killed.

On Dec. 3, 58-year-old Ki-Suck Han was shoved in front of a train in Times Square. A photograph of him on the tracks a split second before he was killed was published on the front of the New York Post the next day, causing an uproar and debate over whether the photographer, who had been waiting for a train, should have tried to help him and whether the newspaper should have run the image. Apparently no one else tried to help up Han, either.

A homeless man, 30-year-old Naeem Davis, was charged with murder in Han's death and was ordered held without bail. He has pleaded not guilty and has said that Han was the aggressor and had attacked him first. The two men hadn't met before.

Service was suspended Thursday night on the 7 train line, which connects Manhattan and Queens, and the Metropolitan Transportation Authority was using buses to shuttle riders while police investigated.

Being pushed onto the train tracks is a silent fear for many of the commuters who ride the city's subway a total of more than 5.2 million times on an average weekday, but deaths are rare. Among the more high-profile cases was the January 1999 death of aspiring screenwriter Kendra Webdale, who was shoved by a former mental patient. After that, the state Legislature passed Kendra's Law, which lets mental health authorities supervise patients who live outside institutions to make sure they are taking their medications and aren't threats to safety.

L.A. offers groceries for guns in annual buyback

"So many young innocent children were mass-murdered in the way that they were, and now the assassination of two firefighters ... just breaks the heart of so many of us, particularly in this holiday season."

The anonymous buyback program allowed weapons to be turned in with no questions asked. Handguns, rifles and shotguns could be exchanged for $100 Ralphs grocery store gift cards. Assault weapons earned a $200 card.

The program, designed to get guns off the streets, usually is held in May. Villaraigosa decided to do it now in the wake of the Dec. 14 shooting rampage at Sandy Hook Elementary School.
